MORGANTOWN — A hair care treatment at a Morgantown-area spa left a woman with second-and-third-degree burns on her head, according to a lawsuit filed this week in Monongalia County Magistrate Court.
The plaintiff, Kelly Anne Thomas, named Tuscan Sun Spa and Salon, LLC as the defendant. She filed the lawsuit Feb. 25.
Cheri Satterfield, the spa’s owner, declined to comment on the pending litigation.
Tuscan Sun offers hair, nail, skin care, beauty, diet and weight-loss services at its Boyers Avenue location in Star City. It also operates locations in Fairmont and Clarksburg, dating back to 2004.
On April 26, 2018, Thomas visited the Star City location to receive a Balayage chemical hair treatment, the suit states. According to Vogue, Balayage is a French hair coloring technique created in the 1970s. It involves the freehand application of color.
The suit claims Tuscan Sun had a duty to provide the hair treatment in a safe manner, make sure its staff was properly trained and experienced in the procedure, and to warn customers of any dangers.
Thomas said she suffered burns to her scalp. Her lawsuit alleges the spa’s conduct was “conscious, reckless and with outrageous indifference to the health, safety and welfare of others so as to subject it to punitive damages.”
Thomas seeks damages for medical bills, pain, suffering and mental anguish, loss of ability to enjoy life, economic loss, permanent injury, attorney fees and court costs.
