MORGANTOWN — The Morgantown Utility Board (MUB) is being sued by A/C Properties LLC over raw sewage that entered one of the company’s properties.
The suit was filed in Monongalia County Circuit Court this month and seeks compensatory and punitive damages, court costs, attorney fees and expenses, and other relief as the court deems appropriate.
According to the suit, on Feb. 14 raw sewage, including human feces and other materials, was discovered at 223 Everhart Drive, off of Bakers Ridge Road, opposite from University High School.
A/C Properties called MUB, who own and maintain the sewage lines. MUB informed A/C Properties that the backup of sewage was caused by a towel blocking the sewage lines.
The suit claimed MUB was negligent in its duties — which include keeping sewage lines open, in repair and free of nuisance.
MUB refused to help remove the feces and “other human waste” despite request for assistance by A/C Properties, according to the suit.
The utility board’s actions caused “substantial interference” with A/C Properties’ business by preventing occupancy in areas impacted.
Chris Dale, MUB spokesperson, said the utility board does not comment on pending litigation.
