Woman drops civil suit in viral road rage case

MORGANTOWN — A woman involved in a viral road rage incident voluntarily dismissed a civil suit she filed against the other driver.

Last week, Amber Generally filed court documents to dismiss the case against William Sothen Sr. and his motorcycle insurance provider. She could file the lawsuit again in the future. No reason was provided in court filings for why she dropped the case.

According to Generally’s lawsuit: In August, Generally was driving north on Interstate 79 from Fairmont to Morgantown when she saw Sothen driving his motorcycle in the same direction. The two traveled onto Interstate 68.

Both ended up on Van Voohris Road, where Generally stopped and Sothen brought his motorcycle next to her. An argument started, and Generally got out of her vehicle.

Generally tried to return to her vehicle, but Sothen “grossly, negligently, recklessly, willfully or maliciously injured the plaintiff.”

A video — shot by a nearby motorist — showed the exchange between the two as they were stopped in the roadway. A scuffle ensued as Sothen stopped Generally from getting back in her car and the two went to the ground. The video was shared on social media.

Sothen was charged with battery in the incident and his criminal case is pending. Generally did not face criminal charges.
