Defendant suffers from conditions found to affect his competency
A man accused of damaging an ATM, breaking into a bank and a defecating on the floor will go to a hospital for treatment.
At a Wednesday hearing, Judge Susan Tucker agreed to transfer Delbert Lemley, 49, from North Central Regional Jail to a hospital where he will undergo 90 days of observation, medication and treatment.
According to a psychological examination, Lemley suffers from mental conditions that make him not competent enough to participate in his own defense or stand trial, Assistant Prosecutor Brandon Benchoff said.
However, the report said Lemley could respond well to treatment. Benchoff asked that Lemley be sent to a hospital for the 90-day treatment period.
Melissa Stacy, Lemley’s attorney, agreed treatment followed by another evaluation would be best.
After treatment, another hearing will be held to discuss the results.
Lemley is accused of breaking into the Clear Mountain Bank in the Suncrest Plaza off Van Voorhis Road in October.
