Man with murder charge denied bond

A man charged with first-degree murder will stay in jail until his case is resolved after a judge rejected a motion to set bond Tuesday.

Michael Corney, 33, is accused of killing Chadwick Malone by shooting him twice  Sept. 23, on Pennsylvania Avenue at the intersection with Pietro Street.

In cases where the possible penalty is life in prison, a magistrate cannot set bond. So, Corney has been in jail since his arrest during an Oct. 13 traffic stop near Marilla Park. 

 At a preliminary hearing   Oct. 23, Magistrate Ron Bane found probable cause for the case to be bound over to circuit court.

If bond was set, Corney’s family could afford to post about $100,000, defense attorney Brandon Shumaker said.

Corney has ties to the community and would live with his sister in Westover and would be able to return to the job he had prior to his arrest to pay for home confinement, if needed, Shumaker said.

Prosecutor Perri DeChristopher opposed bond being set.

She called his criminal history — which includes previous violent offenses, such as participating with other individuals in a burglary where someone was shot in Westover, domestic battery and controlled substance convictions — extensive.

“For the reasons stated by the prosecutor I’m going to deny the motion,” Judge Phillip Gaujot said.
