Lawsuit against Preston sheriff dropped after action taken

KINGWOOD — Indian Rocks Estates LLC, which filed suit last year against Preston Sheriff Dan Loughrie, is now asking for the suit to be dismissed.

Indian Rocks, a mobile home park on W.Va. 7 near Reedsville, had asked the court to compel Loughrie to “perform the duties of his elected office.” It said in a lawsuit filed in Preston Circuit Court that Loughrie failed to enforce three 2017 judgments for wrongful occupation.

In a motion filed Monday, the company said, “The sheriff, after much delay and great efforts by his counsel, has now corrected his tortious conduct and has complied with his statutory requirements.”

Indian Rocks said that made the lawsuit “moot.” However, it does ask the court “to admonish [the sheriff] that such future ignorance to his duties is intolerable.”

According to the lawsuit, an attorney for Indian Rocks contacted Loughrie to try to resolve the issue before the lawsuit was filed, without success.

Indian Rocks is represented by attorney Jason W. Wingfield of Gianola, Barnum, Bechtel & Jecklin. Preston County Prosecuting Attorney Melvin C. Snyder III represented the sheriff.
