Local doctor waives preliminary hearing in sexual abuse case

A Morgantown doctor, who has been charged with sexual abuse, waived his right to a preliminary hearing in Monongalia County Magistrate Court Thursday morning. 

According to court records, Virgil Waid McMillion, 49, Doctor of Osteopathic Medicine and owner of McMillion Medical in Star City, was charged with sexual abuse in the first degree by Star City Police earlier this month. 

The criminal complaint states that police were sent to Star City Nutrition on University Avenue on Aug. 2 for a sexual assault report. 

The victim told officers that after she ignored sexual advances from McMillion he “dragged her into the back room by her arm.” 

Once inside the room, the victim said McMillion began kissing her against her will.  She also recalled in a follow-up interview with police that McMillion grabbed her by the buttocks as she struggled to get away.

Similar accusations were made against McMillion in 2019 when a female health care worker alleged the doctor sexually assaulted her in the emergency department of a hospital in Lewis County.  

McMillion was indicted in July 2021 for second-degree sexual assault following a criminal investigation. He was later found not guilty in a jury trial in 2022. 

The doctor was reprimanded and fined by the West Virginia Board of Osteopathic Medicine (WVBOM) in February 2022, after board members discovered McMillion omitted the fact he was under criminal investigation when applying to renew a letter of qualification (LOQ) — a detail that would have made him ineligible. 

Prior to the discovery, the board renewed McMillion’s LOQ, which expedites licensure through the Interstate Medical Licensure Compact (IMLC), allowing him to obtain a medical license in other states.  He was subsequently issued licensing in 24 additional states. 

Following the discovery of the omission, records show WVBOM ordered McMillion’s LOQ null and void.

His license was then surrendered or revoked in Idaho, Florida, Maine, Illinois, Kansas, Kentucky, Maryland, Louisiana, Michigan, Ohio, New Hampshire, Texas, Utah, Virginia, Oregon, Oklahoma, North Carolina, South Dakota, Vermont, Tennessee, Wyoming, Wisconsin and New York, according to the Federation of State Medical Boards (FSMB).   

McMillion’s license has since been reinstated in New York and he holds active licenses in West Virginia and Pennsylvania. 

Regarding the latest accusations, McMillion was released from custody after posting a $35,000 bond following his arrest.  His case will now be heard by a Monongalia County grand jury.
