Rowlesburg woman pleads guilty to selling Suboxone

KINGWOOD — A Rowlesburg woman pleaded guilty to three felonies Wednesday in Preston County Court, as part of a plea agreement.
Amber Wendy Bolyard, 27, was one of eight Rowlesburg residents arrested in January 2017, following a drug investigation operation by the Preston County Sheriff’s Department.

Preston Assistant Prosecuting Attorney Megan Allender said Bolyard and her then-boyfriend John Barrett sold Suboxone to a police informant. Suboxone is used as part of narcotic dependence treatment plans.

Bolyard pleaded guilty to delivery of a controlled substance, possession of a controlled substance with intent to deliver and conspiracy. The sentence for each of the charges is one- to-five years in prison. The plea agreement asks that Bolyard not be fined and that her sentence be suspended. It was recommended she be given probation and attend drug court.

Allender said the state negotiated what it believed to be the best outcome.
“I don’t believe she has had the opportunity for drug treatment. I believe, and the sheriff’s deputies believe, giving her the opportunity to become a productive citizen is what is best for her and the community,” Allender said.

When Judge Steve Shaffer asked Bolyard which Suboxone clinic in Pennsylvania she bought her Suboxone at, she said she didn’t remember. Shaffer ordered her to give the name to the probation office and asked how she bought the pills.

“I just went to the clinic and gave them money. They sent me to a room and I peed in a cup, and they gave me the pills,” Bolyard said.

Shaffer ordered Bolyard to have a drug test done before she left the courthouse and ordered a pre-sentencing investigation.

If Bolyard is not accepted into drug court, she will not be able to withdraw her plea of guilty and her future will be at the discretion of the court, Allender said. Sentencing is set for Dec. 3.
